1.            Privacy Statement

SowiesoSocial respects your privacy and attaches great importance to the careful handling of personal data. In this privacy statement, we explain which personal data we process, for what purpose, on what legal basis, with whom we share data, and what rights you have. We process personal data in accordance with the General Data Protection Regulation (GDPR) and the GDPR Implementation Act.

1.1.            Data Controller

The data controller within the meaning of the GDPR is Sowieso Helder B.V., trading under the name SowiesoSocial, established at Suikersilo-Oost 2, 1165 MS Halfweg, registered with the Chamber of Commerce under number 66887399. 1.2.            What personal data we process

Which data we process depends on your relationship with SowiesoSocial. We distinguish the following categories:

Visitors of our website

•       Technical details such as IP address, browser type, operating system, language preferences, and visited pages.

•       Data that you provide yourself via the contact form, a quotation request, or a subscription to our newsletter (such as name, company name, email address, and phone number).

•       Information we receive via cookies and similar technologies; please see the cookie statement under chapter 2.

Customers, clients, and business contacts

•       Contact details of contact persons (name, job title, business email address, phone number).

•       Data necessary for the execution of the agreement, invoicing, and debtor management.

•       Correspondence, recordings of meetings, and minutes in so far as these contain personal data.

Job applicants

•       CV, cover letter, contact details, and any other information provided by you.

•       Information from an interview and — with your consent — references.

Target audiences of campaigns that we execute on commission

For our clients, we manage campaigns on platforms such as Meta (Facebook, Instagram), Google, LinkedIn, TikTok, and YouTube. In this role, SowiesoSocial generally acts as a processor on behalf of the client; in other cases, we act jointly with the platform as joint controllers. Processings taking place in that context — including building target audiences, retargeting, look-alike targeting, and conversion measurement — fall under the privacy policy of the respective client and/or platform.

1.3.            Purposes and legal grounds

We process personal data solely for the following purposes and based on the legal grounds mentioned from the GDPR:

•       Performing an agreement or taking pre-contractual measures at request (Article 6 paragraph 1 sub b GDPR).

•       Complying with legal obligations, including tax retention periods (Article 6 paragraph 1 sub c GDPR).

•       Our legitimate interests, including relationship management, business operations, security of our systems, fraud prevention, and (direct) marketing to existing business contacts (Article 6 paragraph 1 sub f GDPR).

•       Your consent, for example for placing non-functional cookies or sending our newsletter to new contacts (Article 6 paragraph 1 sub a GDPR); you can withdraw this consent at any time.

1.4.            Provision to third parties and processors

SowiesoSocial does not provide your personal data to third parties, unless this is necessary for the execution of the agreement, based on a legal obligation, or with your consent. To carry out our services, we engage processors, including:

•       Hosting, email, and office automation providers.

•       Providers of advertising platforms and analytics (such as Meta, Google, LinkedIn).

•       Providers of marketing, CRM, and billing software.

•       External advisors (such as accountants and legal counsels) where necessary.

We enter into processing agreements with all of these parties, in which arrangements are laid down regarding the security and confidentiality of your data.

1.5.            Transfer outside the European Economic Area

Some of our suppliers and platforms (including Meta, Google, and LinkedIn) are located in the United States or process data outside the European Economic Area (EEA). Any transfer takes place solely on the basis of an adequate level of protection, for example through the EU-U.S. Data Privacy Framework, standard contractual clauses of the European Commission, or comparable appropriate safeguards.

1.6.            Retention periods

We do not store your personal data longer than necessary for the aforementioned purposes, unless we are obliged by a legal obligation to keep data longer. For our administration, a statutory retention period of seven years applies. Applicant data is deleted no later than four weeks after completion of the procedure, or – with your consent – stored for a maximum of one year. Contact details of business relations are kept as long as the relationship is active and for a reasonable period thereafter.

1.7.            Security

SowiesoSocial takes appropriate technical and organisational measures to protect your personal data against loss, misuse, and unauthorised access. These include access control, encryption of connections, periodic updates, and awareness among employees. Should a database breach occur unexpectedly, we will act in accordance with the notification obligation under the GDPR.

1.8.            Your rights

Under the GDPR, you have the right to access, rectify, or erase your personal data. In addition, where applicable, you have the right to restrict processing, the right to object to processing, and the right to data portability. In so far as the processing is based on your consent, you can withdraw this consent at any time; the lawfulness of the processing up to that moment remains unaffected.

You can send a request to exercise your rights to info@sowiesosocial.nl. We may ask you to provide proof of identity before we process your request, in order to prevent us from disclosing data to an unauthorised person.

1.9.            Complaints

If you have a complaint about how we handle your personal data, we ask you to contact us first so we can find a solution together. You also always have the right to file a complaint with the Dutch Data Protection Authority (www.autoriteitpersoonsgegevens.nl).

SowiesoSocial uses cookies and similar technologies on www.sowiesosocial.nl. In this cookie statement, we explain what cookies are, which cookies we use, and how you can manage your preferences.

2.1.            What are cookies

A cookie is a small text file placed on your device when you visit a website, which can be sent back by your browser upon a subsequent visit. This database allows us to recognise you, remember preferences, or measure the usage of the website. In addition to cookies, we use similar techniques such as pixels and local storage in your browser; where "cookies" are mentioned in this statement, these techniques are also included.

Third-party cookies / embedded content

On our website, content from third parties may be embedded, such as videos (YouTube, Vimeo), maps, or social media posts. Upon loading these, those third parties may place cookies over which we have no influence. For information about their cookies and data processing, we refer you to the privacy and cookie statements of the respective parties.

2.3.            Consent and management

Upon your first visit to our website, we request your consent through a cookie banner for placing non-functional cookies. You can adjust your choice at any time via the cookie settings on our website. You can also refuse cookies, delete them, or receive a notification when a cookie is placed via your browser settings.
